Agreement to terms

By accessing or using the OnCall service ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Description of service

OnCall provides an AI-powered voice receptionist that answers phone calls on behalf of your business, collects caller information, detects emergencies, and delivers call summaries and analytics. The Service includes call handling, SMS and email notifications, call recording and transcription, an analytics dashboard, and related features.

Account registration

You must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account.

Subscription and billing

• Subscriptions are billed monthly in advance.
• Each plan includes a set number of call minutes. Overage is billed at the rate specified in your plan.
• All fees are in US dollars and are non-refundable except as required by law.
• We may change pricing with 30 days' written notice.
• Applicable sales taxes will be added based on your business location.

Cancellation

You may cancel at any time. Cancellation takes effect at the end of your current billing cycle. No partial refunds for unused portions.

Acceptable use

You agree not to use OnCall to:

• Violate any applicable law or regulation
• Handle calls for illegal businesses or services
• Deliberately generate fraudulent call volume
• Reverse-engineer, copy, or replicate the OnCall AI system
• Resell the Service without written authorization
• Harm, disable, or impair our infrastructure

Call recording consent

OnCall records and transcribes calls as a core part of the Service. You are solely responsible for compliance with all applicable call recording and consent laws in your jurisdiction. OnCall is not responsible for your failure to comply with recording consent requirements.

Data ownership

You retain ownership of your business information and call data. We retain a license to use this data to provide and improve the Service. We do not sell your data. Upon cancellation, you may request a data export within 90 days.

AI limitations and disclaimers

• The AI may occasionally misunderstand callers or provide imperfect responses.
• The AI is not a substitute for licensed professional advice.
• Emergency detection is designed to be helpful but is not infallible. Critical emergencies should be directed to 911.
• Call quality may vary depending on connection quality, background noise, and accents.
• We continuously improve the AI but do not guarantee error-free operation.

Service availability

We strive for high uptime but do not guarantee uninterrupted service. We are not liable for losses resulting from service interruptions.

Limitation of liability

To the maximum extent permitted by law, OnCall shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless OnCall from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any applicable law.

Modifications to terms

We may update these terms from time to time. Continued use after changes take effect constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Louisiana. Disputes shall be resolved in state or federal courts located in Louisiana.
